Summary of facts

Fabrice L. served as Executive Director of Frontex, the European Border and Coast Guard Agency, from 2015 to 2022.

In the course of his duties, he allegedly actively facilitated illegal pushbacks at sea of migrant boats.

Fabrice L. allegedly pursued a migration policy aimed at preventing migrants from entering the EU, whatever the cost – including in human lives.

Amnesty International France recalls that everyone is presumed innocent until proven guilty according to law.

Legal proceedings

April 23, 2024: LDH and Utopia 56 filed a complaint against Fabrice L. for “complicity in crimes against humanity” and “complicity in torture.” The PNAT issued submissions seeking a finding of inadmissibility, considering that, under the international instruments and European mandates governing the Frontex agency, the material assistance and cooperation provided by Frontex to foreign authorities or coast guards fell within a lawful institutional framework. The investigating judge issued an order confirming the inadmissibility. The civil parties appealed.
In March 2026: the Investigating Chamber of the Paris Court of Appeal held that “the mere abstract examination of the complaint” was not sufficient to ground inadmissibility, and ordered the opening of the judicial investigation in order to determine the “legal nature of the material assistance to the Libyan authorities and determine the imputability of these acts” to Fabrice L., stressing that “the mere circumstance of the existence of international commitments is not sufficient to justify a refusal.”
