Legal proceedings
November 16, 2007: the Paris public prosecutor decided to drop the case (decision not to prosecute), relying on an indication from the Ministry of Foreign Affairs regarding an alleged immunity enjoyed by Donald RUMSFELD.
February 27, 2008: seized of a challenge to this decision, the Prosecutor General at the Paris Court of Appeal responded by again invoking immunity from criminal jurisdiction to uphold the decision to drop the case. In his letter of February 27, 2008, the Prosecutor General considered that the conditions for applying the legislation “are not met, due to Donald RUMSFELD’s departure from French territory, although no prosecutorial act set the prosecution in motion during his brief stay”.
May 25, 2008: in an open letter to the French authorities, the organizations called for an intervention with the Prosecutor General at the Paris Court of Appeal so that his position of February 27, 2008, granting immunity from criminal jurisdiction for acts of torture, be reviewed.
