Summary of facts
The French group TotalEnergies reportedly operated a gas field that was used to produce kerosene used by Russian aircraft during bombing raids in Ukraine, including on the Mariupol theater, an attack that killed approximately 600 people. The complaint follows revelations by Le Monde and the NGO Global Witness published in August 2022, according to which TotalEnergies held a 49% stake in the Termokarstovoye gas field, in Siberia.
Amnesty International France recalls that everyone is presumed innocent until proven guilty according to law.
Legal proceedings
January 10, 2023: the complaint was dropped on the ground of an “insufficiently characterized offense”; the NGOs lodged an appeal with the Prosecutor General’s Office at the Paris Court of Appeal, which took no further action.
March 30, 2023: Razom We Stand and Darwin Climax Coalition filed a new complaint with civil party application for “complicity in war crimes.”
October 19, 2023: The investigating judge issued an order declaring the complaint with civil party application inadmissible for procedural reasons, considering that the NGOs did not meet the required five years of existence and did not have the appropriate corporate purpose to bring legal proceedings in international crimes cases.
